Transsexual's fight to wear girl's clothes at school

A transsexual schoolboy who was kicked out of school for wearing a tight skirt, frilly blouse and padded bra is taking legal action to demand his right to wear girl's clothing.

Lawyers for the student, who was born male but has a female identity, claim he should be allowed to go to school and "express his transgender disposition".

School staff said the student had been allowed to wear female blouses, pants and make-up, but wearing more 'flamboyant' clothes would be 'disruptive'.

The student, identified in court papers as "Pat Doe", is currently being taught at home until the legal issues surrounding his case are resolved, The Enterprise newspaper reports.

A judge must decide whether the eighth grade student can continue attending school in Brockton, Boston, Massachusetts, wearing girl's clothes. The student has lodged a preliminary injunction against Brockton School Committee.

The student's lawyer Jennifer L Levi, of the Gay and Lesbian Advocates and Defenders in Boston, said "Pat Doe" has a First Amendment right to express himself, and the same dress code should be applied to him as to other girls at the school.

Attorney Edward Lenox, opposing the injunction on behalf of the unnamed school, said there had been a "pattern of flamboyance and disruption" by the student, who now wanted to be even more flamboyant.

He said: "The student will show off, apply make-up in front of other students."

Mr Lenox said the student had blown kisses in class and shown up in a long, slinky black dress. On another occasion, he wore a tight-fitting skirt, padded bra and filly blouse. He said that wearing such clothes "will be disruptive to the educational process".
